The pets were on the default when they were purchased so mode kill. But the crime was attempted murder of XXX.. I didn't use the order command OR break sanc to attack. It doesnt make sense.

Yeah, pets have always done this if they were on mode kill. Although to be honest, mode stun would probably just get you nailed for attempted mugging.
