In-character, I'd recommend roleplaying the capture as clever bounty NPCs simply surprising you when you weren't ready.
I can vouch for him right here. He was arrested last night, in the north, by a bounty NPC. The thing is, we had been fighting bounty NPCs by the buttload before this happened. We ran into a group of enemy PCs and scared them off, then regrouped and took a moment to kill yet more bounty NPCs and reorient ourselves (and argue amongst ourselves; can't forget that part), then we moved out. The next bounty NPC we ran into arrested him. Unless he decided to toggle auto surrender on during that very brief interlude, it's a bug.
Personally, I have set my auto surrender off, then aliased "auto surrender" in my client to send the text "BLANK." There is literally no way for me to surrender unless a bug does it for me.
