You're not being "let off," you're being forced to serve the punishment for your crime. If they couldn't find the money when a bank robber was arrested, he'd probably be more likely to get the maximum sentence. If he turned it over, he might have that sentence reduced.

This part I agree with. I've made several posts suggesting/ agreeing with how deathmark/banishment could be put back fully in the hands of players without making life hell for criminals.
I just don't see this (the banishment solution) as necessarily being linked with criminals wanting to avoid having their stuff confiscated. I find no inherent RP violation with the "bury-and-plea" approach.
