Does it sometimes autotoggle? Do I need to check this when I log in? I'm so confused=P

It does. It's a very notorious bug.

It has definitely owned me before too. I was pretty excited about it.

I don't see how any AUTO setting would change without a user executing the required command. Methinks the victims of an accidental surrender do not wish to admit that they may have left the setting enabled after a prior run in with the law.

In-character, I'd recommend roleplaying the capture as clever bounty NPCs simply surprising you when you weren't ready.

No, Alshain. It has happed to me over the years in various characters, and there is somehow something that bugilly toggles auto-surrender. It's a real mystery and no-one has been able to locate it yet, but it does happen.

Your best bet is to double check it as soon as you enter a group with other players in it. The bigger the group, the more important it is to check. Even if they say "Oh we're just going to Radi Kenga" you never know if someone is going to up and decide they need to get some stave or wand or pick up another group member in the country you're outlawed in.

Some organized, kind souls remember to ask "We're going to ___, is anyone outlawed here?" but others of us are way, way too absent-minded to think of things like that.

I know I've left it on by mistake before, but I'm pretty sure there have been times where I KNOW it was off, and I still surrendered.

I really wish we could just get a -surrender- command. Instead of a toggle.

I can vouch for him right here. He was arrested last night, in the north, by a bounty NPC. The thing is, we had been fighting bounty NPCs by the buttload before this happened. We ran into a group of enemy PCs and scared them off, then regrouped and took a moment to kill yet more bounty NPCs and reorient ourselves (and argue amongst ourselves; can't forget that part), then we moved out. The next bounty NPC we ran into arrested him. Unless he decided to toggle auto surrender on during that very brief interlude, it's a bug.

Personally, I have set my auto surrender off, then aliased "auto surrender" in my client to send the text "BLANK." There is literally no way for me to surrender unless a bug does it for me.

If you have any information as to how this bug may be getting triggered, you are welcome to send it to Dulrik. This has been a problem, but has been so far impossible for anyone to track down.
